d) Other events related to the themes of health, self-development, spirituality and training. 

2. The provision of the services mentioned in the previous number presupposes the acceptance of these terms and conditions. 

3. All Terms & Conditions for ritatojal.com are subject to the Portuguese law, and to the ethical standards of professional service providers. 


Article 4 - Use of data 

1. By agreeing to these Terms & Conditions for ritatojal.com, the user declares to accept communication sent by ritatojal.com within the scope of the company's activity. 

2. For the purpose of the preceding paragraph, this communication includes emails related to the scheduling or holding of sessions, assessment of servicesfeevdback on sessions, subsequent monitoring of clients, and for marketing purposes. 

3. Users may request clarification on the use of personal data through the email address hello@ritatojal.com.

Article 5 - ritatojal.com reserves the following rights: 

1. Suspend or close, permanently or temporarily, partially or totally, according to our will or need and at any time, the platform in use, without prior notice. 

2. Claim intellectual property on all content contained in ritatojal.com, on multiple platforms, except for those resulting from links to external sites and others whose sources and authorship are duly marked. 

3. The rights mentioned in the previous paragraph include those that affect the structure of the site, texts, films, photographs, logos. 


Article 6 - Duties of ritatojal.com The duties of ritatojal.com to its users are: 

1. Ensure compliance with the applicable ethical rules and respect the technical guidelines issued by the entities with responsibility for the regulation of professional activities operated through ritatojal.com. 

2. Make available the technological resources necessary to carry out the contracted services, under conditions that allow effective user sessions. 

3. Develop the necessary actions to guarantee digital security. 

4. Provide clarifications that are legitimately requested by users. 

5. Proceed with the return of amounts paid on services that may eventually be canceled under the terms of this document. 


Article 7 - User Rights The users of ritatojal.com benefit from the following rights: 

1. Guarantee of the correct qualification and training needed for the services ofered at ritatojal.com. 

2. To be reimbursed in case of failure to hold a scheduled session due to technical or unexpected issues not attributable to the user and attributable to ritatojal.com, under the terms of this document. 

3. To claim, at any time, the right to forget and erase the data provided, except in cases when, by law, the preservation of such data is mandatory. 


Article 8 - User Duties For the purposes of navigation, registration and access to services provided through ritatojal.com, the user has the following duties: 

1. Make available true and updated information whenever requested, assuming responsibility in case the accuracy and veracity of the data is not verified. 

2. Provide true and accurate information for the purposes of charging of services provided by ritatojal.com. 

3. Save the access data to the platform, maintaining the appropriate reservation on these, which are personal and non-transferable. 

4. To communicate with ritatojal.com, verbally or in writing, using appropriate language. 

5. To guarantee the technical conditions of access to the services provided by ritatojal.com, namely equipment and internet service, without which ritatojal.com will not be responsible for the incapacity or deficiency in access. 

6. Make use of the technological capabilities provided by ritatojal.com exclusively for the purposes for which they have been made available. 

7. Respect intellectual property rights regarding content at ritatojal.com. 


Article 9 - Scheduling and conducting sessions 

1. The execution of services is preceded, sequentially, by the following acts on the part of the client: Declaration of agreement and acceptance of Informed Consent, Terms and Conditions of ritatojal.com and Terms of the Privacy and Security Policy; Paying for the service; Scheduling.

 2. After making the payment, the client is notified by email of the payment confirmation. 

3. In case of need, the client can reschedule a session with a minimum of 72- hours notice. 

4. In case of cancellation, the amount paid will be returned, provided it is communicated with a minimum of 72-hours notice. 

5. For the purposes of the provisions of paragraphs 3 and 4 of this article, failure to observe the 72-hour notice period implies non-refund of the amount paid. 

6. Upon scheduling a session, the link to the video conference system is sent to the user. 

7. Sequentially, the user and Rita Tojal start the session by accessing the platform at the scheduled time. 

7 - If the user does not attend the session at the indicated time, a 15-minute tolerance will be granted, after which the session will be canceled, with no right to refund the amount paid. 

8 - If the user arrives late to the session, within the 15-minute tolerance, the session takes place in the remaining time scheduled for the session, finishing at the originally scheduled time. 

9 - If there is any delay on Rita Tojal’s part, the client may claim the refund of the amount paid, in which case the session will be canceled. 


Article 10 - Payments and returns 

1. Payments made by users for the contracted services will be made through the means provided by ritatojal.com; 

2. Payment is made in advance and must be made up to 72 hours before the session. Only with the payment and receipt of payment, the session will be effectively confirmed. 

3. The user may cancel the scheduled session up to 72 hours before the start time. 

4. The cancellation of the session under the terms mentioned in the previous number generates a refund to the same form of payment used to buy the service. 

5. In the event of a non-scheduled session due to technical issues not attributable to the user, the user has the right to reschedule or be fully refunded the amount previously paid. 

6. In the event of a non-scheduled session due to technical or other issues attributable to the user, there is no place to refund the amount paid by the user. 


Article 11 - Treatment of Personal Data 

1. ritatojal.com complies with the Portuguese and European Union legal regimes applicable in terms of data processing and protection. 

2. ritatojal.com makes adequate efforts to preserve computer security and safeguard data against possible cyber attacks. 


Article 12 - Provision of data ritatojal.com may provide data provided by the user, only if the national authority with the competence to do so determines it. 


Article 13 - Exclusion of liability 

1. ritatojal.com is not responsible for damages or irregularities committed by third parties in a fraudulent manner and that may constitute a crime, namely for usurpation of personality or illegal access to data. 

2. ritatojal.com is not responsible for service disruption resulting from the use of outdated technology by the user. 

3. ritatojal.com is not responsible for technical deficiencies that are the responsibility of others, namely energy and internet service providers, which are fundamental to the normal functioning of the services. 

4. ritatojal.com is not responsible for the contents of third party sites accessible through links available on this platform, nor do we subscribe to its contents, its use being the exclusive responsibility of the users. 


Article 14 - Copyright 

1. All contents of the ritatojal.com platform are the property of Rita Tojal, Unipessoal Lda., with their rights reserved under the terms of the law. 

2. Rita Tojal, Unipessoal Lda. reserves the right to prosecute agents for any violation or abuse that may be committed in matters of usurpation of intellectual property. 


Article 15 - Litigation and enabling rules 

1. All services provided through ritatojal.com are subject to Portuguese and European Union legislation. 

2. In case of divergence or litigation, a procedure will be initiated with the competent Portuguese legal institutions. 


Article 16 - Final dispositions 

1. The classification of all matters that are not explicitly patented in these Terms and Conditions of Use of the ritatojal.com platform will be subject to the applicable Portuguese and European Union legislation, to the regulatory and guiding provisions of the regulatory bodies of the professions that exercise activity on the platform. 

2. The Lisbon District Court is designated to settle any disputes resulting from the relationship established within the scope of ritatojal.com.

Computer security Rita Tojal, Unipessoal Lda., NIPC 516223615, the company that runs ritatojal.com, undertakes to employ the necessary, adequate and proportional security measures in terms of technological and data security, for safeguarding integrity in the treatment of customers' personal data. In order to enhance computer security, customers must use equipment that is properly protected against computer viruses, worms and harmful software. Customers should also actively take measures that enhance the security of communications, namely the secure configuration of the navigation program, the installation of updated antivirus software as well as security barrier software and the non-use of software of dubious origin. Without the adoption of these measures, the risk of improper access by unauthorised agents is increased. 

2. Updates The Terms of the Privacy and Security Policy presented by ritatojal.com may be updated, with the date of the last version being mentioned in the header of this statement. 

3. Responsible for the processing of personal data In compliance with article 24 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, Rita Tojal, Unipessoal Lda., NIPC 516223615, the company that runs ritatojal.com, with headquarters in Rua das Narcejas, 37, 2750-749 Cascais, Portugal, is the entity responsible for the collection and processing of personal data within the scope of the ritatojal.com platform activity, for the purposes referred to in this document, with the exception of the purposes referred to in the section “Legal basis for the processing of personal data by psychologists”. 4. Privacy Policy Terms Personal data collected within the scope of the relationship between users and the ritatojal.com platform, will be treated with strict observance of what is established in the General Regulation on Data Protection (Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016 - “GDPR”) and Law No. 58/2019 of August 8. In this sense, ritatojal.com undertakes data treatment in compliance with the principles enshrined in article 5th General Regulation on Data Protection (Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016 - “GDPR”) and Law No. 58/2019 of 8 August, the collection being strictly limited to application for purposes that are adequate, relevant and limited, considering the purposes of data treatment. ritatojal.com is also committed to ensuring the integrity and confidentiality of the data, namely by adopting organisational and security measures necessary to protect the data in the face of any illicit treatment. ritatojal.com is committed to ensuring that all data relating to health will be exclusively handled by Rita Tojal, who is subject to special confidentiality duties and framed by ethical and deontological duties. All personal data that is not related to health will be exclusively treated by professionals linked to the duty of professional secrecy. Mere interaction with the ritatojal.com platform does not require data collection. 

5. Processing of personal data - Legal basis The use of services available on the ritatojal.com platform implies the processing of personal data. Considering the nature of the activity, some of the processed data may fall under the category of sensitive data. All data provided by the respective holder are based on the respective consent, and for that purpose the holder must explicitly declare that consent in an informed manner and in accordance with this privacy policy at the time when the matter is questioned. The declaration of informed consent and acceptance of the Privacy and Security Policy as well as the Terms and Conditions of Use of the Platform presumes the previous reading of the same, and the declarant cannot evoke being ignorant after acceptance. 

6. Legal basis for the processing of personal data by Rita Tojal as a psychology professional The special categories of data that will be subject to treatment by Rita Tojal as a psychology professional, while responsible for data treatment, will be limited to the need arising from the provision of contracted services between the client and ritatojal.com, these being linked to the duty of confidentiality. 

7. Processing of personal data - Purposes All personal data provided by customers, namely data related to contacts, identification, and other elements necessary for the purpose of scheduling sessions and marketing within the scope of ritatojal.com's activities will be treated for the preparation of sessions, scheduling sessions and other operations relating to the management of services, subject to prior and explicit consent by clients under the terms set out in this document. Personal data provided by customers may also be subject to treatment in the context of the need to establish contact between ritatojal.com and the customers, namely to evaluate the service provided, assess the need for continuity of service, billing, manage complaints or litigation or for the fulfilment of legal obligations, when justified. Personal data provided by customers may also be processed for the purpose of sending information via email, within the exclusive scope of ritatojal.com's activity, namely commercial information about products, marketing content, sales, or other initiatives that may be promoted. 

8. Categories of recipients of personal data Under the terms of the law, customers' personal data may be disclosed to the authorities as long as they have the legitimacy to request them. The processing of costumer’s personal data for the purposes mentioned above will be carried out by ritatojal.com through workers designated for this purpose. The processing of clients' personal data for the purposes mentioned above may also be carried out by other subcontracted entities, with responsibilities for managing the platform and with activity in terms of accounting treatment. These entities will have a commitment to treat the data in accordance with the rules established by ritatojal.com and in absolute compliance with the legislation in force. 

9. Period of retention of personal data Personal data collected by ritatojal.com in the context of its activity may be subject to treatment during the period in which consent is maintained or for another period if this is due to applicable legislation. In order to guarantee access to the platform's functionalities, the data relating to access will be preserved for as long as the customer's account remains active. Access data will be kept for a maximum period of twenty four months after the last use, ritatojal.com committing itself to erase it after that period. 

10. Other rights - Rectification, access or deletion of personal data, limitation of processing, right to object to processing and right to portability of personal data. Right to withdraw consent. The ritatojal.com client can at any time determine the full access to the personal data that they hold, as well as requesting its elimination, rectification or limitation of the treatment, as well as oppose the portability of the data and its treatment. The ritatojal.com client also has the right to withdraw consent, at any time, for the processing of data for the purposes indicated, and this withdrawal of consent takes efect from the date of the request. In order to exercise the aforementioned extensions, the ritatojal.com client may communicate the decision by sending an email to hello@ritatojal.com.

Complaint to the supervisory authority The ritatojal.com client has the right, under the terms of the law, to submit complaints regarding the processing of personal data to the competent supervisory authority, in this case the National Data Protection Commission, to the email address geral@cnpd.pt, or to the postal address: Rua de São Bento, nº 148, 3, 1200 - 821 Lisboa.

Informed consent for clients in a psychology session 

The provision of psychology services through the use of technologies to mediate the interaction between professional and client, for counselling or therapy, is a scientifically validated practice. 

This practice observes and binds professionals to the Code of Ethics of the Portuguese Psychologists Order, as well as to all applicable legislation, namely in matters relating to the protection of individuals with regard to the processing of personal data and the free movement of such data. 

It is in compliance with these assumptions that ritatojal.com provides the following information regarding the interaction to be established within the scope of therapeutic practice and collects explicit and informed consent from clients for the development of the underlying technical and commercial relationship. 


1. The data collected by ritatojal.com, within the scope of the activity developed, are intended to: 1) Inform Rita Tojal, in order to prepare the sessions to be held; 2) carry out the accounting and billing operations inherent to the services provided; 3) marketing purposes; 4) proceed with the documentation of the client's file. 

2. The ritatojal.com platform, within the scope of the activity developed, stores data necessary for the preparation of the sessions, giving them greater efficiency, data necessary for carrying out accounting and billing operations inherent to the services provided and other data necessary for marketing purposes. 

3. The data collected by the ritatojal.com platform will be kept for a maximum period of twenty-four months after the last use, except for those that, by legal imperative, must be kept for a longer period. 

4. For the psychology sessions, the client authorises me carry out, if deemed strictly necessary, audio or video records for the purpose of later transcription of information, me being responsible for the destruction of this content within 24 hours after obtaining it. 

5. No audio or video recording by the client is allowed during the sessions. 

6. Data subjects can at any time request information about their personal data existing on the ritatojal.com platform. 

7. Data holders may request at any time the erasure and/or destruction of personal data existing on the platform, except for those that for legal reasons must be kept (eg data for tax purposes) and without prejudice to the contrary provision applicable in specific legislation. 

8. The use of information and communication technologies (ICT) in psychological intervention may also present a set of challenges and limitations, namely technological problems resulting from slow connections; issues related to security, privacy and confidentiality that arise from the use of ICT, including mechanisms for recording and tracking communications or improper access by third parties to the content of interventions. It is important that the client ensures the safety of their equipment, by installing programs that detect threats; and that the client does not use public computers to carry out the sessions. 

9. In the event of a breach of data security, the respective data owners will be informed of the incident. 

10. The security risks that may occur during or after the use of communication technologies are common to all platforms with an internet presence, namely data theft, data hijacking or contamination of equipment by use by the client outdated software. 

11. ritatojal.com excludes itself from any liability arising from the identified risks or others that cannot be directly and exclusively attributable to it. 

12. The price for the services is what appears on the ritatojal.com platform at the time the client makes the payment. After payment, the corresponding payment receipt is sent via the email address provided by the latter. 

13. The communication established between the client and Rita Tojal can be synchronous or asynchronous. Regardless of the typology, communication takes place through the ritatojal.com platform, using one of the following modalities: Video, Audio or Chat. 

14. By agreement between the professional and the client, diferent modes of communication may be used in a combined manner. By subscribing to this consent, the client declares that they are duly informed on all matters relevant to the provision of the services to be contracted and for the preservation of their rights, freedoms and guarantees.
